WHEN YOU PURCHASE A MACHINE FROM US IT IS SOLD STRICTLY "AS SEEN" AND YOU WILL BE ASKED TO SIGN SEVERAL DOCUMENTS TO 
SHOW YOU HAVE READ, UNDERSTOOD AND AGREE 
WITH OUR TERMS AND CONDITIONS. 
NO MACHINES WILL BE SOLD WITHOUT THESE DOCUMENTS.

Sold as Seen (Spares or Repair)
When purchasing a machine from A&V Trade Sales it will be purchased with no warranty or guarantee. Not fit for road usage/ sold as seen/ spares or repair – each of our machines has to fit one or all of these categories for us to be able to sell them at guide price. As all of our machines fit this it enables us to supply them exempt of any form of warranty/guarantee including statutory warranty (this does not mean that all of our machines are unfit for road usage as many are supplied with new or current mot’s).
You are advised to check over our machines prior to purchase and all documents are available for you to view (unless stated that a machine has no documents). You will be requested to sign a warranty disclaimer to show that you have accepted and acknowledged our conditions of sale. Our machines are priced according to condition and current trade/insurance values. Many machines will be of an age where they will not be listed in any current trade guide. Therefore they will be priced upon suggested trade value at the time which will be researched.
If you are unsure of any of the terms and conditions outlined above, further information can be obtained by speaking to a member of staff in the office. If you require any further information we strongly advise you seek legal advice prior to purchase.

Deposits
Deposits are taken in the form of cash or cheque. Card payments are accepted but a charge of 3% will be added to the total amount.
Deposits only secure a machine for 7 days. If you do not collect your machine after the 7 day period you will lose your deposit and the machine will be put back up for sale. Deposits are non refundable.

Cheque Payments
If purchasing a machine by cheque, the machine will not be released until the cheque is cleared by your bank. We advise that this process can take up to 6 working days (This does not affect your 7 day deposit period and does not include weekends and bank holidays).

Card Payments
All major Credit & Debit cards accepted.  Credit cards up to a value of £200. All cards are subject to a 3% c

Storage
Additional storage for any vehicle is available upon request, prices start from £10 per day.

Delivery
We offer a delivery service within a certain radius. Prices start from £30 and alter according to distance. Further details of this service are available on request.

Customers under 16

Customers under the age of 16 
People under the age of 16 are classed as minors. Anyone under the age of 16 who wishes to purchase any machine must be accompanied by a parent or guardian. The Parent or guardian will be asked to counter sign the disclaimer. Then and only then will we allow the transaction to complete. Please note: both the customer and the parent/guardian may be asked to provide identification at the time of the transaction.
Notice Regarding Machines supplied with a new MOT and Tax
Please note we have a minimum of seven working days (subject to spares availability) to complete the service, MOT and taxing of any machine which are supplied with these in the purchase price. Thank you for your patience and understanding.
At A & V Trade Sales our main aim is to keep our customers happy with the product they purchase from us . We are as honest as we can be about all of our machines, but no guarantees can be made. All of the terms above can not and will not be changed in anyway to cater for specific customers. These terms apply to everyone. If you have any specific questions, please do speak to a member of staff in the office

Consumer Law

Consumer law is a legal area that focuses on giving protection to the consumer when they buy a product or service. This part of the legal system is designed to make sure that consumers buying a product or service are protected against issues such as fraud and mis-selling, for example. Via bodies such as the Office of Fair Trading this legal area also makes sure that consumer markets work in a fair and equitable manner.

So, for example, as a consumer, your rights when you make a purchase will be protected in various ways by consumer law. This could apply to the general purchase of products and services down to specialist areas. So, for example, a website selling a range of products must act in a specific way to make sure that your purchase is fair and that your rights are protected. Or, if you buy a financial product such as a loan or a credit agreement then according to the law you must be given a cooling-off period’ where you can change your mind if you wish.

There are various elements of consumer law that protect your rights and that can be used to help you solve a case against a retailer or sales company. These include:

  • The Sales of Goods Act -- this act gives you a range of statutory rights when you buy something. So, for example, under this act any products that you might buy must be fit for purpose, of the right quality and as they were described to you before you made a purchase.
  • The Consumer Protection (Distance Selling) Regulations -- these consumer law regulations protect your rights if you buy something via the Internet or over the phone. They will, for example, set clear guidelines on what retailers must tell you about products, services, costs and delivery and they give you a seven day cancellation period.
  • The Consumer Credit Act -- this act looks after your rights if you take out some form of credit agreement. It specifies that your contracts here must show you specific information including your credit agreement amount, payment information, credit charges and APRs and your rights to cancel.

    Consumer law as a whole is managed in the UK by the Office of Fair Trading. If, however, you need to make a complaint or have a problem then your case may well be handled at a local level. Here, for example, you might take up your case with your local trading standards office who can give you practical help and advice. This maybe your best first step if you think you have a problem.

The customer is of the full understanding that this machine is being sold as a project and not fit for the purpose of use on the public highway and is therefore being sold as spares or repair without any form of warranty or guarantee. Once this machine has left our premises it is the sole responsibility of the customer. Once the customer has signed this disclaimer it is to be noted that this is a full declaration from them that they understand the implications in relation to this purchase.

Machines purchased by minors (people under the age of 16) must be accompanied by a parent or guardian, then and only then will we allow the transaction to complete. Parents or guardians will be asked to counter sign the disclaimer.

This exemption of warranty also includes the current statutory warranty.

MOT ROAD WORTHINESS NOTIFICATION:
No machines are sold from these premises without this. 

A&V Trade sales would like you to note that when providing a motorcycle with a full or partly expired MOT that this does not constitute to any form of warranty, guarantee or any form of consumer statutory guarantee. All machines sold are sold not fit for the purpose, sold as seen or spares or repair. We strongly advise that you seek legal advice to your legal position when purchasing a motorcycle at A&V Trade Sales. We advise that all motorcycles provided with a new or part MOT are serviced and checked prior to use on the public highway. Please may we bring to your attention the paragraphs below outlining the department of transport legal stance on the supply of an MOT.

The MOT certificate confirms that at the time of the test, without dismantling it, the vehicle met the minimum acceptable environmental and road safety standards required by law. It doesn’t mean that the vehicle is roadworthy for the length of time the certificate is valid. The MOT certificate is also no guarantee of the general mechanical condition of your vehicle. The test doesn’t cover the condition of the engine, clutch or gearbox.

An MOT Test pass confirms that, when the vehicle was examined in accordance with Section 45 of the Road Traffic Act 1988, it met the minimum legal requirements for those items prescribed under the Act. It does not mean that the vehicle fully meets all legal requirements or that it will continue to be roadworthy for the next year. It is your responsibility to keep the vehicle maintained so that it would always meet MOT standards and be free from other defects.

RE: V5C REGISTRATION DOCUMENTS


Please note: A&V Trade Sales supply motorcycles and scooters with the V5C registration document and do not purchase machines without them. The documents are sent in bulk per week to the DVLA. A&V Trade Sales keep a log of all the documents sent and the dates after the sale of all machines. All sold machines are supplied with either a HPI document V5C copy and/or V5C new keeper supplement

A&V Trade Sales will not take any responsibility for documents once posted to the DVLA and accept no liability if the purchaser does not receive a document on time or at all from the DVLA. This is either due to postal error or an error within the DVLA processing department. The DVLA charge £25.00 for a new V5C document .If this issue were to arise at any point the purchaser would have to take this up with the DVLA or post office and not A&V Trade Sales.

A&V Trade Sales will not pay a contribution towards the cost to replace the V5C document in the event of the purchaser failing to receive a document in their name.
